Although the incidence and composition of HECs has been well characterized, little is known about how HECs assess their performance. In order to describe the incidence of HEC self-evaluation, the methods HECs use to evaluate their performance, and the characteristics of HECs that influence self-evaluation, we surveyed the readers ofHospital Ethics. 290 HECs in 45 U.S. states, the District of Columbia, Puerto Rico and three Canadian provinces, completed questionnaires. Of the 241 HECs included in the data analysis, 97.9% had performed (...) some self-evaluation. Responding committees largely made formative rather than summative evaluations and appeared to evaluate performance in light of their own objectives rather than basing assessments on specific structural, process, and outcome measures of quality. Responding committees used certain evaluation criteria more extensively than others — among these, the number of participants and staff knowledge of the service provided — with the choice of criteria differing with the function being evaluated. Eight characteristics of HECs influenced the probability of self-evaluation, including age, number of beds and meetings, the existence of a mission statement, and a budget. The presence of certain characteristics made HECs six times more likely to evaluate their performance than HECs without the characteristic. (shrink)

Donald Davidson's theory of mind is widely regarded as a normative theory. This is a something of a confusion. Once a distinction has been made between the categorisation scheme of a norm and the norm's force-maker, it becomes clear that a Davidsonian theory of mind is not a normative theory after all. Making clear the distinction, applying it to Davidson's theory of mind, and showing its significance are the main purposes of this paper. Environmental ethicists have frequently criticized ancient Greek philosophy as anti-environmental for a view of philosophy that is counterproductive to environmental ethics and a view of the world that puts nature at the disposal of people. This provocative collection of original essays reexamines the views of nature and ecology found in the thought of Plato, Aristotle, the Stoics, and Plotinus. Cancer and its treatment pose challenges that affect not only patients but also their significant others, including intimate partners. Accumulating evidence suggests that couples’ ability to communicate effectively plays a major role in the psychological adjustment of both individuals and the quality of their relationship. Two key conceptual models have been proposed to account for how couple communication impacts psychological and relationship adjustment: the social-cognitive processing (SCP) model and the relationship intimacy (RI) model. These models posit different mechanisms and outcomes, (...) and thus have different implications for intervention. The purpose of this project is to test and compare the utility of these models using comprehensive and methodologically rigorous methods. Aims are: (1) to examine the overall fit of the SCP and RI models in explaining patient and partner psychological and relationship adjustment as they occur on a day-to-day basis and over the course of 1 year; (2) to examine the fit of the models for different subgroups (males vs. females, and patients vs. partners); and (3) to examine the utility of various methods of assessing communication by examining the degree to which baseline indices from different measurement strategies predict self-reported adjustment at 1-year follow up. The study employs a longitudinal, multi-method approach to examining communication processes including: standard self-report questionnaires assessing process and outcome variables collected quarterly over the course of 1 year; smartphone-based ecological momentary assessments to sample participant reports in real time; and laboratory-based couple conversations from which we derive observational measures of communicative behavior and affective expression, as well as vocal indices of emotional arousal. Participants are patients with stage II-IV breast, colon, rectal, or lung cancer and their spouses/partners, recruited from two NCI-designated comprehensive cancer centers. Results will be published in scientific journals, presented at scientific conferences, and conveyed to a larger audience through infographics and social media outlets. Findings will inform theory, measurement, and the design and implementation of efficacious interventions aimed at optimizing both patient and partner well-being. (shrink)

The politics of Slavoj Zizek has been attracting greater attention in recent times, particularly as a result of some of his recent public commentary key contemporary political issues, such as the Occupy Movement, the election of Donald Trump, and the Greek referendum. Zizek has advocated a range of political strategies in the course of his writings, including ‘over-identification’. However, while the strategy of over-identification appears to have given way to a preference for the Lacanian Act, subtraction and Bartleby politics, (...) the paper examines whether Zizek’s recent public interventions signal a return to his politics of over-identification. First, the paper briefly examines the underlying theory behind a politics of identification and how Zizek conceives it. The paper then turns to three events – Wikileaks, the election of Trump, and Trumps withdrawal of the US from the Paris Agreement on climate change – to examine the application of a politics of over-identification to contemporary political issues. The paper includes by highlighting further key points in Zizek’s theoretical edifice that reinforce the relevance and applicability of his politics to contemporary issues. (shrink)

Around the globe, economists affect markets by saying what markets are doing, what they should do, and what they will do. Increasingly, experimental economists are even designing real-world markets. But, despite these facts, economists are still largely thought of as scientists who merely observe markets from the outside, like astronomers look at the stars. Donald Davidson assigns truth a central role in his theory of meaning but he also makes truth a guiding methodological principle in metaphysics. Truth is inexorably connected to belief and meaning, and no one of these concepts has theoretical priority over the others. I argue that there is a methodological circularity in Davidson’s account of how the world contributes to the truth of our beliefs and utterances. The difficulty for Davidson is in providing an account of how speakers share (...) a common world while denying an ontologically privileged domain of entities and further claiming that being supervenes on truth. I suggest that the Heideggerian notion of disclosedness offers one solution. (shrink)

The moral error theorist claims that moral discourse is irredeemably in error because it is committed to the existence of properties that do not exist. A common response has been to postulate ‘companions in guilt’—forms of discourse that seem safe from error despite sharing the putatively problematic features of moral discourse. The most developed instance of this pairs moral discourse with epistemic discourse. For many commentators in bioethics and the law, safety is the fulcrum for evaluating the ethics of human reproductive cloning. Carson Strong has argued that if cloning were effective and safe it should be available to married couples who have tried to have children through various assisted reproductive technologies but been unable to do so. On his view, cloning should be available only as reproductive last resort. I challenged that limited use by trying to show that the arguments Strong adduces (...) in favor of reproductive somatic nuclear transfer for married couples extend to same-sex couples as well, who face a different kind of infertility. I also went on to argue that his justifications would in fact extend the legitimate use of SNT to any couples regardless of whether they had fertility difficulties or not. (shrink)

Picking up the question of what FLaK might be, this editorial considers the relationship between openness and closure in feminist legal studies. How do we draw on feminist struggles for openness in common resources, from security to knowledge, as we inhabit a compromised space in commercial publishing? We think about this first in relation to the content of this issue: on image-based abuse continuums, asylum struggles, trials of protestors, customary justice, and not-so-timely reparations. Our thoughts take us through the different (...) ways that openness and closure work in struggles against violence, cruel welcomes, and re-arrangements of code and custom. Secondly, we share some reflections on methodological openness and closure as the roundtable conversation on asylum, and the interview with Riles, remind us of #FLaK2016 and its method of scattering sources as we think about how best to mix knowledges. Thirdly, prompted by the FLaK kitchen table conversations on openness, publishing and ‘getting the word out’, we respond to Kember’s call to ‘open up open access’. We explain the different current arrangements for opening up FLS content and how green open access, the sharedit initiative, author request and publisher discretion present alternatives to gold open access. Finally drawing on Franklin and Spade, we show how there are a range of ‘wench tactics’—adapting gifts, stalling and resting—which we deploy as academic editors who are trying to have an impact on the access, use and circulation of our journal, even though we do not own the journal we edit. These wench tactics are alternatives to the more obvious or reported tactic of resignation, or withdrawing academic labour from editing and reviewing altogether. They help us think about brewing editorial time, what ambivalence over our 25th birthday might mean, and how to inhabit painful places. In this, we respond in our own impure, compromised way to da Silva’s call not to forget the native and slave as we do FLaK, and repurpose shrapnel, in our common commitments. (shrink)

The study used critical discourse analysis (CDA) to elucidate normative structures of ethical behavior in university research administration which may be useful for knowledge transference to future studies of research integrity. Research administration appears to support integrity in the research environment through four very strong normative domains: (1) respect for authority structures; (2) respect for institutional boundaries; (3) professionalism; and (4) a strong sense of virtue. The strong norm structure of research administration, however, appears to be threatened by the fifth (...) domain, (5) political power, which is inhabited by prestigious faculty with tenure, top-down authority misalignment, and the power for some institutional members to circumvent the system. The strong normative structure also appears threatened by the overall consequentiality of the regulatory environment, and shifting contexts that threaten personal virtue. In the end, the normative structure is fluid, politically acquiescent to power, and ambiguous. Although the professional core of the norm structure is strong, the strengths and weaknesses in the overall system can be connected to poorly constructed elements of the institutional environment. Digital media seem to be marked by process. The digital image itself is produced by software processes and the constant flux of code. Further this, interaction with digital systems involves a constant process by which a so-called 'user' comes into contact with various machinic occasions. It seems that in light of these processes it is impossible to maintain an aesthetic or media theory that pictures a self-contained and psychologised subject interacting with a static and inert object. How then can we (...) begin to think about digital aesthetics through a process philosophy rather than the traditional and reductive subject/object distinction found in so much aesthetic theory? This paper seeks to address this problem by enacting Alfred Whitehead's process philosophy, informed by Gilles Deleuze, Isabelle Stengers and Steve Shaviro and work it through several examples of recent manifestations of interactive media art, including work by Martin Wattenberg, Dennis Del Favero, Jeffrey Shaw and Peter Weibel. I work Whitehead's process philosophy through these artworks to illustrate the performative nature of software processes and the manner in which these processes affect the aesthetics of interaction. I also use these works to illustrate a concept of interaction that privileges process and events rather than a concept that focuses upon an individual human user. In this paper I propose to view the 'user' as a set of occasions – as a particular condition that is produced by various user-initiated actions – rather than an enduring subject that is able to distance herself from the object of aesthetic contemplation. By doing this I move toward a theory in which user-occasions, machine-occasions and their interpenetration actualise the aesthetics of media art. Whitehead allows me to think outside of the binary oppositions that divide the world into knower/known or subject/object relationships. Throughout the argument I unpack Whiteheadian concepts such as actual entities, the unison of immediate becoming and, in general, the primacy of the event, bringing these concepts to bear on individual case studies of interactive media art. Whitehead's general thesis is that materiality and permanence are created by a continual process. Viewing the digital encounter through this theoretical framework I position the aesthetic experience of interaction as that which emerges from the fluctuations of process. The event of interaction is a necessarily hybrid process in which human occasions become supplemented by technology and the aesthetic event becomes innately coupled to the processes of the machine. In this paper I am not interested in any notion of consciousness or a psychologised human 'user', rather I am interested in a particular condition that takes place as user-initiated processes work with machine-initiated processes. This is because, for Whitehead, process comes before consciousness; it is the process of actual entities that prompt the consciousness into being. In this paper I thus propose interaction with digital systems as the commingling of contemporary actual occasions, shifting emphasis from a conscious human user and instead focusing on the process of the encounter that precedes this conscious experience. This essay offers a critique of the philosophical ‘turn to affect’, a formation represented here by the work of Brian Massumi and Mark Hansen. In such discourses, affect is celebrated as an entity that is inimical to conceptualisation, subjective intention and linguistic transcription. However, insofar as it boasts such qualities, affect cannot, I argue, be celebrated or made the object of a critical ‘turn’. In drawing on Deleuze's work, contemporary scholarly discourses on affect dispense with Deleuze's most profound proposition: of (...) an order of philosophy, perception, reflection and thought that originates outside, or is no longer dependent upon, a human perspective. This paper offers an anxious survey of factors inducing boredom or indifference in the readership of environmental writing and criticism. The first is the inertia of limited assumptions in writers and critics about how to engage readers’ attention, with inadequate ideas of what ‘genuine reading’ would be. Secondly and more insidiously, modern readers are usually now immersed in consumerist cultural contexts actively geared to encourage boredom as a market force. Reduced thresholds of attention become effectively a political agent, usually a (...) reactionary one. Next the question is asked: is ‘the reader’ a unified subject? That is, how far are environmental texts and fears unwittingly appealing to unacknowledged fantasies of violence and harm? A final threat to readerly engagement with environmental criticism in particular is that, as the conditions of the ‘Anthropocene’ worsen, just to engage more reading and readers on environmental issues comes to seem less and less adequate, even evasive, an academic theatre only of performing opinions.
